The President of Ukraine Petro Poroshenko appealed to the Constitutional Court to declare unconstitutional the decision of the Verkhovna Rada of depriving the title of President Viktor Yanukovych. A decree published on the website of the court.
«Since the law whose constitutionality is challenged, does not have a normative nature, the Verkhovna Rada, to accept it, to act contrary to the norms of the Constitution and, therefore, it is contrary to Article 19, part 2 the Constitution, which requires the Parliament to act on the basis of and within the powers and in the manner envisaged by the Constitution of Ukraine, in connection with the request to declare the law of Ukraine “On the deprivation of the rank of Yanukovych the President of Ukraine” dated February 4, 2015 so that does not meet the Constitution of Ukraine ie, unconstitutional, “- said in the document.
In a submission Poroshenko notes that, according to the norms of the Constitution, Parliament can not deny the title of President of Ukraine. According to Article 85 paragraph 10, the displacement of the head of state is possible in order a special procedure – impeachment. According to Article 111, the impeachment initiated by the majority of Parliament, for it creates a special commission, which examines the reasons for the deprivation of rank. When present, Parliament must decide by at least two-thirds of its constitutional composition, after verifying the case by the Constitutional Court and after obtaining its conclusion.
Thus, summed up Poroshenko, the Constitution provides only one case of deprivation of the rank of the president, and no authority can not adopt a separate law on deprivation of such a status without making changes to the Constitution.
