The issue of the arrest of Zaur Dadaeva refused to hand over to the military court – RBC

The Moscow City Court refused to hand over to a military court the question of extending the arrest of Zaur Dadaeva – the alleged murderer Boris Nemtsov, reports RBC.

According to the document, Dadaev was dismissed from service March 1, 2015, after the assassination of Nemtsov. Thus, in accordance with the requirements of the Code of Criminal Procedure the decision to arrest Dadaeva had to take a military court, the lawyer insisted. Himself Dadaev also confirmed in court that left the battalion “North” only on March 1.

In turn, the representative of the investigative team asked the court to consider that the answer to the request of the Investigative Committee at the command of internal troops only came April 23 – after the trial. The prosecutor, in turn, added that the decision on the jurisdiction of the case of the murder of Nemtsov will be made after the transfer of the investigation to the court for consideration on the merits. The solution of the arrest of Dadaeva court took after his dismissal from the service, both in terms of civilian.

Earlier, on June 15, “Kommersant” reported that the order of dismissal Dadaeva of the battalion “North” was signed after the Nemtsov murder. The publication notes that it was only on March 1.

At the same time the Moscow City Court upheld the decision to extend the arrest Dadevu until 28 August. Earlier, the court took a similar decision on the complaint of another person involved in the case – Khamzat Bakhaeva.
